General Terms and Conditions

We are glad that you have decided for a course in our language school and thank you for your trust! To ensure that the course becomes a learning experience for you, you will find our general terms and conditions below:

§ 1 Contracting parties

(1) The website fluente.ch and fluente.club is operated by Katarína Bertušek, with its registered office at Brackenweg 14, 5200 Brugg, CH-5200 Brugg, hereinafter referred to as the “school operator”.

(2) In the case of course participants who are not yet of legal age, the contract must be signed by a parent or legal guardian. In this case, a contract is concluded between the school operator and the legal representative.

The legal guardian is fully responsible for his / her children for all obligations arising from this contract and is liable for any damage caused to his / her child.

§ 2 Scope and adoption

(1) These General Terms and Conditions (GTC) apply to all educational services provided by the school operator to natural and / or legal persons.

(2) By concluding a contract between you and the school operator, these general conditions become an inseparable part of the teaching contract.

§ 3 Conclusion of the contract

When you receive your electronic, written, telephone or personal registration for a course, the teaching contract will not be concluded between you and the school operator until the school operator has sent you a written confirmation of the course.

§ 4 Your rights

Fluente offers you a non-transferable, exclusive and limited right to access, use and display the content of this site. This only applies if you fully comply with this agreement and the terms and conditions. The materials on this site are provided for your personal and non-commercial use only.

§ 5 Use of the service

Your right to access and use the services provided to you by the school operator applies exclusively to you personally. You may not transfer this right to another person or company. You have access to fluente and its services or you can only use it for the purposes for which it was intended – that is, to learn a foreign language.

It is your responsibility to maintain the confidentiality of your Fluente account, username and password. You agree to notify the school operator of any unauthorized use of your personal account – by email to info@fluente.club. In addition, your login information must be current and correct to ensure that the service works. Failure to do so will affect the accuracy and efficiency of the service for you.

We may terminate or change your account, claim or remove any username associated with your account if this is necessary due to changes in law or for security reasons, or if we have legitimate reasons to believe that you are using the Services incorrectly or against the interests of other subscribers. in this case, you are in breach of this agreement. We are not required to keep a log of your account or any data or information that you may have stored through your account and / or services.

§ 6 Course and collection fees

(1) Course fees are defined in the tuition agreement or information, which can be found on the website: www.fluente.club. Any exchange rate materials will be charged separately and are not included in the exchange rate price. You can order DLLAB textbooks through our e-shop.

(2) The school operator reserves the right to assign unpaid fees for the course of the collection company or to instruct the collection company to claim the fees for the course.

(3) Costs in case of late payment: processing fee (at the earliest from the 70th day after the invoice date, when handed over to the debt collection service provider) depending on the amount of the claim, maximum amount in CHF: 50 (up to 20); 70 (up to 50); 100 (up to 100); 120 (up to 150); 149 (up to 250); 195 (up to 500); 308 (up to 1,500); 448 (up to 3,000); 1,100 (up to 10,000); 1,510 (up to 20,000); 2,658 (up to 50,000); 6% of the claim (from 50,000).

(4) Invoices can be paid in Euros (EUR) or Swiss Francs (CHF).

§ 7 Teaching unit and teaching hours

There are 3 forms of teaching:

(1) Basic course – 1x lesson per week (50 min) + video material

(2) Standard course – 2x lessons per week (2×50 min) + video material

(3) Intensive course – 4x lessons per week (4×50 min) + video material

§ 8 Payment terms

(1) The invoice (s) for the payment of the course fee will be sent to you electronically. Exchange rate fees are payable immediately upon receipt of confirmation of the exchange rate and must be paid no later than the first date of the exchange rate.

(2) The course fee must be paid to the bank account specified in the invoice.

§ 9 Contractual periods and probationary hours

(1) The duration of the contract is 1 month, unless it is an extraordinary event, when the contract is signed for 3 months.

(2) The test hour can be completed after paying the course fee, from which, if you decide not to take the course after this hour, an administrative fee of EUR 15 will be invoiced. If you do not complete the hour and do not cancel your registration at least 24 hours before the agreed course date, we will no longer be able to cancel the course.

§ 10 Termination of the contract

From school owner

(1) The school operator may terminate the contract unilaterally and immediately if there are serious reasons. An important reason is given if you violate the terms and conditions stated here or disrupt the lesson in such a way that the other participants of the group will no longer be guaranteed a smooth and successful completion of the course. In the event of termination by the school operator, the return of already paid course fees is excluded.

(2) You can cancel your registration up to five working days before the start of the course. In this case, the already paid course fee will be refunded.

(3) After the expiration of this period, it is not possible to refund the exchange rate due to the incurred wages and planning costs.

§ 11 Missed course dates

(1) In the case of group lessons, it is not possible to replace missed course dates and these must be paid in any case. In the case of private lessons, if you unsubscribe in time, i. at least 24 hours before the start of the lesson, the date of the missed lesson can be added and will not be charged.

(2) If you do not cancel your private lesson at least 24 hours before the start of the lesson or do not cancel it at all, the lessons will be charged to you provided there are no compelling and unforeseeable reasons (such as a serious accident or the like) that delayed or did not justify cancellation. . In case of illness or injury, the school operator reserves the right to request a certificate from a doctor.

(3) In the case of course participants who are not yet of legal age, the legal representative is responsible for ensuring that the participant of the minor course actually participates in the purchased course. The legal representative is primarily responsible for ensuring that the participant of the minor course arrives at the course premises in time and is picked up in time. The school operator does not take any responsibility for missed course dates and the resulting consequences.

§ 12 Place and teacher

The lessons take place online using the Zoom application. You procure and maintain technical equipment (especially computer, internet connection, etc.) at your own expense.

The student receives a link from the teacher to the lesson at least one day in advance and undertakes to download this application in advance and test whether the audio and video will work well for him.

§ 13 Group hours

(1) In order to open group courses, it is necessary that at least 3 participants attend. The number of participants is given by the type of language course:

(1) Basic course – unlimited number of participants

(2) Standard course – max 10 participants

(3) Intensive course – max 6 participants

The school operator takes care of the homogeneous composition of the groups with regard to all relevant pedagogical factors.

(2) If fewer registrations are accepted into the group course than the required minimum (if no more specific information is available, there are at least three course participants), the school operator reserves the right to reduce the number of hours or waive the course. Course fees will be refunded at the end of the month.

§ 14 Consent

The school operator is entitled to publish pictures of course participants on social networks and on the Internet. If no written objection is raised, there is consent within the meaning of Art. 28 Paragraph 2 of the ZGB for publication.

§ 15 Insurance

(1) The course participant or legal representative is responsible for liability insurance.

§ 16 Repeal of previous general conditions / place of jurisdiction / applicable law

(1) With these general terms and conditions, all previous terms and conditions are considered canceled. In the event of a conflict with the previous terms and conditions, this version of May 1, 2021 applies.

(2) In case of incompatible differences, the district court in Brugg, Switzerland has territorial jurisdiction. Mandatory place of jurisdiction remains reserved. Only Swiss law applies.

(3) The school operator reserves the right to additionally and unilaterally change these general conditions.
